The Law
Multiple layers of federal law protect housing rights in the United States. Below is a plain-language summary of the primary statutes that govern our practice.
Civil Rights Act of 1866
Prohibits all racial discrimination in the sale or rental of property. There are no exceptions. This statute predates all subsequent fair housing law and remains fully in force.
Fair Housing Act (Title VIII of the Civil Rights Act of 1968)
Declares a national policy of fair housing throughout the United States. Makes it illegal to discriminate in the sale, lease, or rental of housing — or to make housing otherwise unavailable — on the basis of race, color, religion, sex, handicap, familial status, or national origin.
Americans with Disabilities Act (ADA)
Title III prohibits discrimination against persons with disabilities in places of public accommodation and commercial facilities.
Equal Credit Opportunity Act (ECOA)
Makes discrimination in any aspect of a credit application unlawful on the basis of race, color, religion, national origin, sex, marital status, age, or reliance on public assistance.
North Carolina State Law
North Carolina fair housing statutes and the NC Real Estate Commission's rules may provide broader protections than federal law. Every transaction anywhere in this network operates under NCREC jurisdiction, and our practice reflects that fully.
Protected Classes
Under federal law and the NAR Code of Ethics, the following characteristics may never be used as a basis for discrimination in any real estate transaction, professional service, or employment practice:
Sexual orientation and gender identity are protected under NAR's Code of Ethics (Article 10) regardless of whether they are explicitly covered by applicable state law.
REALTOR® Commitment
Travis Old is a member of the National Association of REALTORS® and is bound by NAR's Code of Ethics — a standard that exceeds federal law in several respects.
